National Workshop on Stages of Criminal Trial and Rights of Victims at CUSB on 19th June 2021
If the police is not lodging an FIR then what are the other remedies available to victims? This important question was answered by Supreme Court Advocate Mr. Nand Sagar. He was sharing the legal tips with the participants in a national workshop organised by Legal Aid Clinic, School of Law and Governance, Central University of South Bihar (CUSB). The National Workshop on “Stages of Criminal Trial and Rights of Victims” was organised in collaboration with Bihar Legal Network, Patna on 19th June 2021.
Mr. Sagar started his talk with making a connection between the theoretical knowledge and the practicalities at the courtroom from his own experience. He explained the importance of the Indian Penal Code, Criminal Procedure Code and Evidence Act for the criminal process. He also explained the process of lodging an FIR in the police station, With help of the practical instances, he gave information about bail and its types. He stressed upon the students to help the people when they become lawyers as well as taught some special ways of filing FIR. Besides, he very substantially enumerated the stages of criminal trial, how the criminal justice system is set in motion to the different principles of Criminal Jurisprudence.
Remedies if FIR is not filed? Give your application before S.H.O for lodging F.I.R. If S.H.O refused to register your F.I.R. Then send representation before D.S.P. & S.P. alleging that S.H.O humiliated & did not register F.I.R. If S.P & D.S.P didn’t take action on your representation. Then move application before C.J.M under Section 156(3) for lodging F.I.R & Make party to .S.P. D.S.P and S.H.O as well. C.J.M court will give directions to lodge F.I.R. How to lodge F.I.R against Police under To S.H.O. SC/ ST act ?Under Section 4 of SC/ST Act lodge F.I.R against police & Court also for lodging F.I.R. Move application before S.P in this regard. If police refused to lodge your F.I.R.
Earlier the program started with the introduction of the workshop by moderator of the session, Rashmi Sinha, law student, CUSB. Further, Dr. Deo Narayan Singh, faculty co-ordinator, Legal Aid Clinic and Assistant Professor, CUSB, whole-heartedly welcomed all the guest speakers, professors, students and other attendees and announced the commencement of the Workshop. He began with very famous lines of Justice Hugo Blake of U.S. Supreme Court which meant that justice cannot be done so long as it depends upon the capacity of a person that how much he can pay. How the judiciary can help the victims and how the university has worked in the field of legal aid was also well elaborated by him.
The second speaker of the program, Advocate Savita Ali, Advocate Patna High Court and Director Bihar Legal Network, highlighted the work of Bihar Legal Network and gave valuable information about the real state of affairs at ground level. Pointing out the failure of the government in implementing the existing laws, she presented many examples and told how to help the victims. She advocated the practice of putting one’s views as an advocate clearly in the court and told how people can be saved from the atrocities of the police. She succinctly explained how lack of awareness about compensations, remedies and other legal tools results into non-accessibility of the benefits, especially to women victims, that Legal System in our country aims at providing and also categorically highlighted other loopholes like red-tapism that required to be addressed. Besides both the speakers also answered queries of students and broke the wall of ambiguities and ignorance, standing before the law students.
The program concluded with the vote of thanks by Dr. Neetu Kumari, Assistant Professor, Law, CUSB who encouraged the students to contribute in free legal aid and participate in workshops like this to gain practical know-how of legal proceedings.
